By accessing or using any service provided by Blue Horizon Solutions ("Company", "we", "us", or "our"), including the PSC Platform and RightShip Platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Services
Blue Horizon Solutions provides maritime SaaS products including:
- PSC Platform — Port State Control inspection intelligence and compliance tracking for vessels.
- RightShip Platform — RightShip vetting intelligence and risk monitoring for ship owners and managers.
Services are provided on a subscription basis per vessel per month or per year, as described on our pricing page.
3. Account Registration
To access our platforms, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Subscriptions and Payments
- Subscriptions are billed on a recurring basis (monthly or annually) as selected at purchase.
- Payments are processed securely through Creem.io.
- All fees are in US Dollars (USD) unless otherwise stated.
- Subscription fees are non-refundable except as required by applicable law or as explicitly stated in our refund policy.
- We reserve the right to modify pricing with 30 days' notice.
5. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose or in violation of any regulations
- Share your account credentials with unauthorised parties
- Attempt to reverse engineer, copy, or replicate our software or data
- Use automated means to scrape or extract data from our platforms
- Interfere with or disrupt the integrity or performance of our services
6. Intellectual Property
All content, software, data, and materials provided through our services are the exclusive property of Blue Horizon Solutions or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use our services for your internal business purposes only.
7. Data and Confidentiality
We treat your vessel data and business information as confidential. We will not disclose your data to third parties except as described in our Privacy Policy or as required by law.
8. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components. Maritime compliance decisions remain the sole responsibility of the vessel operator.
9. Limitation of Liability
To the maximum extent permitted by law, Blue Horizon Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.
10. Termination
Either party may terminate a subscription at any time. Upon termination, your access to the service will cease at the end of the current billing period. We reserve the right to suspend or terminate accounts that violate these Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu, India.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or by posting a notice on our website. Continued use of our services after changes constitutes acceptance of the updated Terms.
